Asbestos at School:

During an interior renovation at a local school, asbestos dust was accidentally released while replacing sheetrock. Remediation of the released asbestos resulted in significant cleanup costs. Administration was forced to relocate the students to nearby schools until the remediation was complete.

Grading Project:

While grading in preparation for construction of a new police station, the contractor accidentally ruptured an underground petroleum pipeline causing thousands of gallons of petroleum to spread onto neighboring properties. Significant cleanup expenses were incurred both on-site and off-site.

Transportation Accident:

A contractor was transporting a load of waste to a nearby landfill. While transporting the waste, the truck overturned on a highway. The waste spilled into a nearby creek and killed a number of fish. The contractor is now facing $100,000 in cleanup costs and natural resource damages.

Senior Living Complex:

Residents at a newly completed senior living complex contracted legionella, which required serious medical treatment and hospitalization. The source of the legionella was attributed to faulty HVAC system installation at the senior living facility. The HVAC subcontractor and general contractor were held responsible for bodily injury, clean up costs and business interruption.

NODS (Non-Owned Disposal Site):

A contractor was responsible for disposing of construction debris at the job site. Wastes were accepted at a local landfill. Four years later, the landfill was listed as a state Superfund site when the facility went out of business. The contractor and the project owner were both named as potentially responsible parties for the landfill cleanup.

Design Defect – Windows:

A specialty contractor installed windows according to the provided architectural plans and specifications. During construction, they made a substitution in building materials without obtaining the design architect’s approval. The seals around the windows subsequently failed, resulting in water intrusion. The project owner and general contractor sued the specialty contractor and required that they replace the windows and remediate the water damage.

Stormwater Runoff During Site Grading:

During a grading project, the job site experienced a 100-year storm event, resulting in failure of stormwater management features and off-site runoff of silt and sediment into a nearby waterway. The contractor responsible for managing the stormwater and sediment onsite received civil fines and penalties from the state environmental department and was held responsible for removing the sediment and restoring the natural habitat.

Mold as a Result of Faulty HVAC Equipment:

An HVAC contractor installed air conditioning units at a multi-family residential community. Due to inadequate insulation around ducting and equipment malfunctions, excessive humidity resulted in mold growth in the individual units. Unit residents were moved off site until the mold was remediated and the HVAC units and insulation were repaired.

Water Intrusion and Mold as a Result of Solar Panel Installation:

Following installation of solar panels at a big-box warehouse, the roof developed a leak. As a result, mold developed in the interior of the building, and the roofing needed to be repaired. The solar energy contractor was held liable by the project owner for the mold remediation.
